Garnishee Garnishment is a process whereby money that is owed to the debtor is diverted to a creditor. Most often it is funds that are owed by a bank or an employer to a debtor which are garnisheed. The bank or employer is called the Garnishee in this process. In order to initiate the process you must file a Garnishee Summons with the Court of Queens Bench and then serve it on the Garnishee. It is possible to garnishee funds used in a joint account, as half the funds will be attributed to the debtor. There may be other creditors who must share in the proceeds. Back |
