How the Deposit or Account Must be ReturnedWhen you return all or part of the security deposit to a tenant (or an account of the security deposit), it must be either given personally or sent by regular, registered, or certified mail. Failure to return the deposit or account in one of these ways is an offence on the part of the landlord. If no forwarding address was left with the landlord, the landlord is responsible for attempting to locate the tenant. The cheque/statement of account is to be mailed to the last known address of the tenant, which may be the rented premises. Any cheque that is returned to you has to be kept as money belonging to the tenant. January 2006 |
