Deductions Required

If you are making deductions from the security deposit you must, within 10 days from the tenant giving up possession of the premises, either:

  • return the balance of the deposit to the tenant with a statement that lists the damages, repair costs, and cleaning charges, or

  • give the tenant an estimate of deductions that will be made and return money that will not be used. Within 30 days of a tenant giving up possession, you must give a final statement and the balance of any money that is owed to the tenant.

If you do not return all or part of a security deposit, the tenant can take legal action against you for the amount outstanding. A tenant can take legal action even when you have given a statement of account, if the tenant disagrees with your accounting.
