Reasons a Condominium Corporation May End a Tenancy

When a condominium is rented, the Condominium Property Act automatically includes some conditions in the tenancy agreement. This means that even if these conditions are not actually written or spoken about, they are still part of the tenancy agreement. The conditions are that:

  • the tenant will not damage any property belonging to the condominium corporation;

  • the tenant will not damage any common property; and

  • the tenant will follow the bylaws of the corporation.

Damage does not include normal wear and tear.

If a tenant breaks one of these implied conditions, the condominium corporation can evict him.
