Landlord's Right to Enter Property

Once you have rented property to a tenant, you give up the right to be on the property unless certain situations arise under the law (unless the tenancy agreement provides otherwise), or unless you are given permission to be on the property.

The law permits re-entry by a landlord in the following situations (see sidebar links):

  • Entry without notice or consent 
  • Entry with notice but without consent
  • Time of entry
  • Form of notice
  • Service of notice

It is always possible for a tenant to give consent at any time for you to be on the premises. If you have been given consent, you do not have to serve the tenant with any notice of entry.
